Writing a Will

What is a Will?

A will is a legal document that expresses your wishes about how your property should be distributed after your death and who should care for any minor children.

Requirements for a Valid Will

Most states require:

  • You must be at least 18 years old.
  • You must be of “sound mind” (able to understand what you’re doing).
  • The will must be in writing.
  • You must sign the will.
  • Two witnesses must sign (who are NOT beneficiaries).

Key Components

  • Executor: The person who will carry out your wishes.
  • Beneficiaries: Who gets what.
  • Guardian: Who will care for minor children.
  • Residuary clause: What happens to anything not specifically mentioned.

Important Notes

Keep your will in a safe place and tell your executor where it is. Review and update your will after major life events (marriage, divorce, birth of children, significant purchases).
