Modifying Child Support

When Can You Modify?

You can request a modification when there’s a “substantial change in circumstances,” such as:

  • Significant increase or decrease in income
  • Job loss
  • Change in custody arrangement
  • Child’s needs change (medical, educational)
  • Either parent remarries or has more children

Step 1: Gather Documentation

Collect evidence of the change:

  • Pay stubs (old and new)
  • Tax returns
  • Medical bills
  • Custody schedule

Step 2: File a Motion

File a “Motion to Modify Child Support” with the same court that issued the original order. Include all documentation.

Step 3: Serve the Other Parent

The other parent must receive notice of your motion and have a chance to respond.

Step 4: Attend the Hearing

Present your case to the judge. Bring all documentation and be prepared to explain the change in circumstances.
